To publish and produce the first comprehensive and really international Yearbook on international humanitarian law! That idea and challenge emerged during the aftermath of the Geneva War Victims Conference in 1993 at the Legal Depart­ ment of the Netherlands Ministry for Foreign Affairs. It would take another five years, numerous discussions with experts in the Netherlands and abroad, and the expertise and knowledge of the staff of the T. M. C. Asser Instituut, before the first volume could be presented. A major inducement for the publication and the preparatory work was also the research which was undertaken at our Institute by young, dedicated scholars in the field of humanitarian law, including state practice, the frequent contacts with Professor Dr. Horst Fischer and his 'Institute for International Humanitarian Law' at the University of Bochum and the cooperation in the publication of the Bofax Newsletter. It was Alan Stephens of Kluwer Law International who came up with most useful comments and sugges­ tions concerning the focus and structure of the new Yearbook Gradually, the 'idea' turned into a reality and all ingredients for the official project launch were present when the search for a competent and enthusiastic managing editor was successful: Avril McDonald, with research experience and having been employed at the Yugoslav Tribunal, turned out to be the right person at the right place at the right time.

<p>In 1998, the city of The Hague commemorated its 750th anniversary. To emphasize that The Hague has been an international judicial center of activities for several decades, a special International Law Conference was organized by T.M.C. Asser Instituut in co-operation with the 'Stichting 750 jaar Den Haag'. The programme of The Hague's 750th Anniversary International Law Conference concentrated on the following themes: international criminal law, interstate dispute settlement, international commercial arbitration, international humanitarian law and the regulation of international trade. Within this framework, a number of panels were devoted to aspects concerning the International Court of Justice, the (future) International Criminal Court and the Iran-US Claims Tribunal. Leading experts as well as representatives of the Netherlands Ministry of Foreign Affairs and various international institutions based in The Hague participated in the programme. This publication is intended for anyone interested in an analysis of the law and practice in these institutions.</p>

International Law and The Hague's 750th Anniversary

The International Criminal Court adopted its Statute in Rome in July 1998. Six months later, a seminar was held in the Netherlands Ministry of Foreign Affairs, which analysed the position of the ICC within the international arena, exploring its relationship to the International Court of Justice, the International Criminal Tribunal for the Former Yugoslavia and the Security Council. A number of contributions to the seminar are included in this volume, as well as essays that reflect on parts of the Statute or on the process by which it was created.

The reservation of title clause plays an important role in contemporary trade. Financially, the reservation of title clause is a cheap and simple form of credit granted by the seller without the involvement of a third party. Legally, the reservation of title clause is more complicated, as it constitutes a transfer of title under a condition precedent; the seller remains the owner of the asset sold until the full price is paid. The rules of substantive law relating to the reservation of title clause differ from country to country. Uniform or harmonized rules of substantive law - or even of private international law - are wanting. In this book, submitted as a doctoral thesis to the European University Institute, Department of Law, Florence, Italy, Ms Jacobien W. Rutgers addresses the question as to the problems which may arise if a reservation of title clause is employed within international transactions, especially transactions between Germany, France, and the Netherlands, and in which mode a solution can be found. The author seeks the solution in private international law, since other means of addressing the problem, such as harmonization and unification of substantive law rules, have failed so far. The book is strong in the analysis of the various conflict of laws solutions and pioneering in how it deals with the question of the extent to which the rules of private international law in this field must be in compliance with European law.

<p>This study considers the ftrst century of international adjudication as a permanent fixture of the international society. By using speciftc international courts to which I was attached, as either a researcher or an employee, I was allowed to consider the various limitations to effective adjudication on the international plane. I recall the day in January of 1992 when the seeds of this manuscript were ftrst planted. I was on the fourth-floor of the Loeb Building at Carleton University leafing through a copy of Thomas Burgenthal's International Human Rights Law in a Nutshell when I came upon a chapter on the Inter-American Court of Human Rights. "How could this be?", I thought. "A little known human rights court in a part of the world fraught with human rights abuses". That semester, I followed through on a course in international human rights law with Professor Maureen Davies and accepted a University Fellowship to do graduate work at Brock University (Canada) the following year. Supported in my interest by Professor James Patrick Sewell, I sought and received an Organization of American States Fellowship to spend an academic year studying the Inter American Court of Human Rights, in situ, in San Jose, Costa Rica. It is from this period that I witnessed ftrst-hand how the Inter-American Court, although similar on paper to the European Court of Human Rights, was limited in its effectiveness through the lack of ftnancing and stafftng allocated to it by American States.</p>

A Century of International Adjudication - The Rule of Law and its Limits

This book comes at a critical time for the future development of sports law. It examines key issues of both contemporary and future importance to the administration of sporting activity in the European Union. The book is par ticularly pertinent coming at a time when European Community law is playing a key role in the restructuring of football's transfer system. This forms only one small, though highly significant, part of the fundamental shift that has taken place in European professional sport; away from the self-regulatory autonomy of sporting bodies towards a system more rigidly codified and governed by main stream legal norms and rules. The law, in particular the economic freedoms provided for under the Treaty of Rome, has become a key weapon in the armoury of those who wish to exploit sport to its full commercial potential, free of self-regulatory constraints. It is not only those desirous of exploiting the economic potential of sport, who have made use of European Community law. As sport has become increasingly com mercialised and commodified, it has also attracted the attention of the institutions of the Community, which have been keen to ensure that sports regulations adhere to Community law.

Professional Sport in the EU:Regulation and Re-Regulation

According to some sources there are around 5,000 national minority groups living in the contemporary world, and about 3,000 linguistic groups. However, this is probably a discretionary assessment as it seems that there are no exact figures with respect to the number and size of minority groups. The existing estimates are usually based on different and sometimes not very clear criteria and mostly take into account those groups and numbers which are the result of the individual choice of a person and are not based exclusively on the objective differences. Notwithstanding this, a brief calculation would indicate that in Western Europe 14. 7% of the total population belongs to minority groups, and the same percentage exists in the Central and Eastern European region - 14. 7%, whereas in the countries belonging to the Commonwealth of Independent States this percentage is slightly higher - at 18. 9%. Throughout the history of the European continent minorities have had a significant impact on political stability and security. Currently, most of the situations of internal tension as well as conflicts, whether internal or international, involve inter-ethnic relations. Thus the international community at large and - for the European minorities more importantly - the European institutions have placed minority issues high on their 'agenda.
