This work is a translation of de Rayneval�s 1803 classic The Institutions of Natural Law and the Law of Nations.� Having been translated into Spanish shortly after its appearance, The Institutions was the reference point of international law for much of the French- and Spanish-speaking world during the Nineteenth Century. As a result, arguably, it is the single most important text of international law to appear between the 1814 Congress of Vienna and the 1919 Treaty of Versailles. This, the first ever English translation of de Rayneval�s The Institutions, provides the English-language world with the last text conceived of, and written, during the era of bilaterial, European, Law of Nations; before the waltz into the Concert of Europe and the growth of multilateral diplomacy, with its end point today�s United Nations. De Rayneval is a product of the Ancien Régime who turned to writing The Institutions after having been purged from the Quai d�Orsay by the French Revolution.� It may be said that in brokering the 1782 Peace of Paris which saw the United Kingdom recognise the United States of America, that Rayneval ended the war which his brother started; as it was Conrad-Alexandre de Rayneval who was the architect of the previous French policy of supporting, and later recognising, the American insurgence of the Thirteen Colonies. "Slavery is the status or condition of a person over whom any or all of the powers attaching to the right of ownership are exercised." So reads the legal definition of slavery agreed by the League of Nations in 1926. Further enshrined in law during international negotiations in 1956 and 1998, this definition has been interpreted in different ways by the international courts in the intervening years. What can be considered slavery? Should forced labour be considered slavery? Debt-bondage? Child soldiering? Or forced marriage? This book explores the limits of how slavery is understood in law. It shows how the definition of slavery in law and the contemporary understanding of slavery has continually evolved and continues to be contentious. It traces the evolution of concepts of slavery, from Roman law through the Middle Ages, the 18th and 19th centuries, up to the modern day manifestations, including manifestations of forced labour and trafficking in persons, and considers how the 1926 definition can distinguish slavery from lesser servitudes. Together the contributors have put together a set of guidelines intended to clarify the law where slavery is concerned. The Bellagio-Harvard Guidelines on the Legal Parameters of Slavery, reproduced here for the first time, takes their shared understanding of both the past and present to project a consistent interpretation of the legal definition of slavery for the future.

The Legal Understanding of Slavery: From the Historical to the Contemporary

Examining international law through the lens of the Middle East, this insightful study demonstrates the qualitatively different manner in which international law is applied in this region of the world. Law is intended to produce a just society, but as it is ultimately a social construct that has travelled through a political process, it cannot be divorced from its relationship to power. The study demonstrates that this understanding shapes the notion, strongly held in the Middle East, that law is little more than a tool of the powerful, used for coercion and oppression. The author considers a number of formative events to demonstrate how the Middle East has become an underclass of the international system wherein law is applied and interpreted selectively, used coercively and, in noticeable situations, simply disregarded. Slavery has taken on added significance in the twenty-first century as a result of its inclusion in the Statute of the International Criminal Court and it being a component part of the 2001 UN and 2005 Council of Europe conventions against trafficking. With limited and conflicting case-law on the issue, the compiling of the Travaux Préparatoires of the 1926 League of Nations and the 1956 United Nations conventions become essential in seeking to holding States or individuals responsible for violations of international law touching on slavery. The Law and Slavery: Prohibiting Human Exploitation

This study considers the ftrst century of international adjudication as a permanent fixture of the international society. By using speciftc international courts to which I was attached, as either a researcher or an employee, I was allowed to consider the various limitations to effective adjudication on the international plane. I recall the day in January of 1992 when the seeds of this manuscript were ftrst planted. I was on the fourth-floor of the Loeb Building at Carleton University leafing through a copy of Thomas Burgenthal's International Human Rights Law in a Nutshell when I came upon a chapter on the Inter-American Court of Human Rights. "How could this be?", I thought. "A little known human rights court in a part of the world fraught with human rights abuses". That semester, I followed through on a course in international human rights law with Professor Maureen Davies and accepted a University Fellowship to do graduate work at Brock University (Canada) the following year. Supported in my interest by Professor James Patrick Sewell, I sought and received an Organization of American States Fellowship to spend an academic year studying the Inter American Court of Human Rights, in situ, in San Jose, Costa Rica. It is from this period that I witnessed ftrst-hand how the Inter-American Court, although similar on paper to the European Court of Human Rights, was limited in its effectiveness through the lack of ftnancing and stafftng allocated to it by American States.
