The Committee, nbovo named, contracted with Messrs. Whitehcr & Sheldon, of Quincy, to erect tho tower, in stone, for 818,500. But the subsequent addition of stone steps, on several sides, and a broad stone platform about the base, together with the grading of the hill, increased the expense to about 822,000. The tower is sixty-two feet in height above the summit of Mount Auburn. 1 It is built on the general plan of some of the round towers of the feudal ages, and contains a gallery, battlements, f Gothic windows, and a spiral stairease of stone. The stones are smooth hammered on both sides, so that each stone makes a part of both the inside and outside surface of the wall. The horizontal surfaces of all the stones being level and true, it is impossible that any structure, of the same materials, should be more substantial. The summit being above the tops of the highest trees, gives, from its platform, a panoramic view of the Cemetery and surrounding country. A landscape of cities and villages, interspersed with woods, cultivated fields, and large sheets of water, constitutes this view. "The admissibility," says a well-known writer, "of extrinsic parol testimony to affect written instruments is, perhaps, the most difficult branch of the law of evidence."2 The chief reason is that most of the questions brought under this head are out of place; there is a grouping together of a mass of incongruous matter, and then it is looked at in a wrong focus. Because the rules intimated by this title deal with writings, i. e., with things which in their nature are evidence of what they record, it is assumed that they belong to the law of evidence. But in truth most of the matters with which they are concerned have no special place in the law of evidence; and the way out of these perplexities will be found in clearly recognizing what the law of evidence is, and in eliminating the various parts of the present title which do not belong under that head and allotting them to their proper place. It will suffice to say that although scrupulous cleanliness and the avoidance of all unnecessary infection should be strenuously enforced in all parts of the brewery, it is particularly on the coolers and refrigerators that attention in this respect should be unceasing. Organisms infecting brewings in the early stages are at any rate killed during boiling, and their direct deteriorating influence thereby checked; infection after the wort is pitched is not so dangerous as during cooling, for organisms and wild yeasts are checked and crowded out by the actively developing pitching yeast. But during cooling and refrigeration, the wort is in its most critical condition, and as this infection is to some extent inevitable during that process, every means should be taken to reduce it to its very lowest amount. But however careful we may be, we cannot altogether avoid infection during cooling and refrigeration, and assuming that by every available means all evitable infection has been excluded, there will yet be many organisms to deal with; and whether this irreducible minimum of organisms is to be of harm or not will depend upon two factors, the composition of the wort, and the vigour of the subsequent fermentation. The conditions under which a vigorous fermentation, so far as the yeast is concerned, is attainable, will be considered subsequently. The silver being assayed and weighed with scarcely any loss of time, the first mentioned cause of fluctuation in the relative value of the current medium compared with bullion is avoided. Certain masses of it being then certified (without any stamp being affixed on the metal) to be of a given quantity and fineness, the value is transferred from individual to individual by the medium merely of the bank books, and thus the wearing of the coin being prevented, one cause of depreciation is removed. A free right is also given to withdraw, melt, and export it; and thus the other and principal source of the occasional fall of the value of the current medium of payment, below that of the bullion which it is intended to represent, is also effectually precluded. In this manner at Hamburgh, silver is not only the measure of all exchangeable value, but it is rendered an invariable measure, except in so far as the relative value of silver itself varies with the varying supply of that precious metal from the mines. The number of farms in 1910 was 891, while in 1900 there were 921 farms enumerated. Stock raising was considerably more important then field crops. The figures for 1909 were: Cattle, 14,695; horses and mules, about one thousand six hundred; swine, 32,844; sheep, 5,218; goats, 3,449; poultry, 28,683. The acreage of the chief crops was: Corn, 9,132; cotton, 1,533; peanuts, 977; sweet potatoes and yams, 717; besides a considerable acreage in sugar cane and oats. About 20,000 trees were in orchard fruits, and the growing of figs and pecans has received most attention in tropical fruits and nuts. Jasper County This is one of the original counties of the Texas republic. Its area was included in the De Zavala empresario grant of 1829, though settlement had begun previously. In the Texas Almanac for 1858, George W. Smyth, who had lived in that vicinity since 1830, said that when he came there was a settlement of about thirty families scattered from the Sabine to the Neches and known as "Bevil's settlement," from John Bevil, the original settler. A wilderness of forty miles separated that settlement from the "Ayish Bayou settlement" near San Augustine, while it was seventy miles to the "Cow Bayou settlement" on the south. In this account the first comers were named John Bevil, James Cheshire, Thomas Watts, John Watts, John Saul, Isaac Isaacs and Hardy Pace, who settled about 1828 or before. In 1830 this settlement was organized as a precinct of the municipality of Nacogdoches. Thus the conception of ideal beauty does not to tend to narrow his doctrine, but to widen it.
