Throughout the nineteenth century and twentieth century, various attempts were made to define and control problematic behaviour in public by legal and legislative means through the use of a somewhat nebulous concept of ‘indecency’. Remarkably however, public indecency remains a much under-researched aspect of English legal, social and criminal justice history. Covering a period of just over a century, from 1857 (the date of the passing of the first Obscene Publications Act) to 1960 (the date of the famous trial of Penguin Books over their publication of Lady Chatterley’s Lover following the introduction of a new Obscene Publications Act in the previous year), Public Indecency in England investigates the social and cultural obsession with various forms of indecency and how public perceptions of different types of indecent behaviour led to legal definitions of such behaviour in both common law and statute. This truly interdisciplinary book utilises socio-legal, historical and criminological research to discuss the practical response of both the police and the judiciary to those caught engaging in public indecency, as well as to highlight the increasing problems faced by moralists during a period of unprecedented technological developments in the fields of visual and aural mass entertainment. It is written in a lively and approachable style and, as such, is of interest to academics and students engaged in the study of deviance, law, criminology, sociology, criminal justice, socio-legal studies, and history. In the 19th century it was widely believed by both sexes that men and women should operate in separate domains. Men's innate aggression and superior powers of reason were clearly put to best effect in public life - in politics, in the armed forces, in business and the professions. In contrast, women were expected to be professionals of the home, the environment to which their nature fitted them. This book examines the didactic fiction aimed at middle-class girls and adolescents which burgeoned between 1849 and 1905. Set against a familiar and realistic background, these novels served as guide books for their intended audience. They sought to impart Victorian values regarding acceptable female behaviour and aspirations, and to impress upon the rising generation of home-makers the value of their role. Yet women were increasingly questioning the restrictions placed upon them by the notion of separate male and female preserves. Judith Rowbottom shows how the changes that occured in the feminine stereotypes depicted by the genre reflected changed social mores, such that by the early 1900s "good" women were able to operate in a much wider, if still domestic and separate sphere.

In the climate of social panics that characterized so much of the Victorian period, there was keen consciousness of the threats a variety of crimes posed to social stability. Conversations about crime, particularly via the media, were a major feature of Victorian Britain's daily life, and it was through such conversations that people learned about the nature of crime and criminality, as well as about the individuals who committed crimes or were merely guilty of socially offensive conduct or "bad" behavior. The essays in this book set out to explore the ways in which Victorians used newspapers to identify the causes of bad behavior and its impacts, and the ways in which they tried to "distance" criminals and those guilty of "bad" behavior from the ordinary members of society, including identification of them as different according to race or sexual orientation. It also explores how threats from within "normal" society were depicted and the panic that issues like "baby-farming" caused. Victorian alarm was about crimes and bad behavior which they saw as new or unique to their period-but which were not new then and which, in slightly different dress, are still causing panic today. What is striking about the essays in this collection are the ways they echo contemporary concerns about crime and bad behavior, including panics about "new" types of crime. This has implications for modern understandings of how society needs to understand crime, demonstrating that while there are changes over time, there are also important continuities. Judith Rowbotham is senior lecturer in history, Nottingham Trent University. Kim Stevenson is senior lecturer in law at the University of Plymouth. Rowbotham and Stevenson are founders and directors of SOLON: Promoting Interdisciplinary Studies in Bad Behavior and Crime.
