Judaism's emphasis on the value of human life has always spurred Jews to study medicine, and in this edition we feature a special section on Medicine and Halakhah. In "Gestational Surrogacy," prominent experts in halakhah and medicine describe what they feel are the steps that should be taken to avoid any halakhic questions with this modern medical miracle. In "Criminalization of HIV Transmission," a leading AIDS researcher and a rabbi discuss the serious risks that HIV poses to society and analyze, from the perspective of halakhah, what steps can and should be taken to stem its spread. The third article in this section is a departure from the others. "Obstetrics and the Curse of Eve," rather than celebrating the power of modern medicine, questions whether halakhic considerations such as modesty and hillul Shabbat should not argue for a return to natural childbirth. Several articles deal specifically with Hanukkah. In "The Movement of the Chanukah Menorah Indoors: a Historical and Halakhic Analysis," we see that some Rishonim considered the discomfort felt in lighting the menorah publicly among gentiles as included in what Hazal consider shaat hashmad. The menorah should therefore be lit outdoors only in Eretz Yisrael. A Hebrew article argues that ner Hanukkah is unique in requiring greater financial sacrifice than any other mitzvah and explores the reason for this and the meaning of pirsumei nissa. "What Motivated Antiochus to Issue His Decrees Against the Jews?" explores from a historical perspective why the Greeks were apparently willing to accommodate the religious practices of all nations in their Empire except that of the Jews. Other articles, while not dealing specifically with Hanukkah, touch upon its themes. In an article on "The Soul of the Jew and the Soul of the Non-Jew," we see that since the medieval period, most religious authorities have explained the enmity that Israel constantly experiences from the gentiles as a function of an essential difference in their makeup. Rambam is almost alone in not agreeing with this perspective. In "Rabbi Ishmael, Meet Jaimini" we see how other cultures use methodologies similar to those of the Rabbis to analyze their ancient texts, but a comparison also highlights the differences - among them how Judaism integrated study with prayer. This concept of the search for knowledge and truth is also the subject of a Hebrew essay on Tanur shel Ahinai. A review of R. Benny Lau's "Yirmiyahu: The Fate of a Prophet" shows how understanding the historical context of Sefer Yirmiyahu can help us learn valuable lessons that can be applied to overcome the internal and external challenges to rebuilding the land and people of Israel. In "Where Jerusalem Jews Worship" we learn that only in relatively recent history did Jews retreat to the Western Wall, and that the site that the Hashmonaim rededicated has always remained the holiest site in Judaism. Two scholarly studies round out this volume. "Kedushah, Shema, and the Difference Between Israel and the Angels" focuses on the differences between the Ashkenaz and Sefard versions of Kedushah and detects a conceptual underpinning to the divergent nushaot. A study of the early printings and manuscripts of the Talmud reveals the drawings that Rashi actually drew and traces how printers changed them to meet their needs. Finally a review of a recent book on the Vilna Gaon raises the question as to whether sufficient scholarship is being utilized in the study of Jewish History.

The 25th edition of Hakirah marks another milestone for a journal that was begun in 2004 with the mission of “promoting the intellectual and spiritual growth of the Flatbush Jewish community.” Hakirah has far exceeded its goals, and by volume three the mission had been changed from the “Flatbush Jewish community” to the “Jewish community” as Orthodox scholars and even some non-orthodox scholars from around the world joined us in our mission. Hakirah sought to accomplish its goal by “providing an opportunity for members of our community who have been studying in depth to disseminate the results of their study for careful review” and “encouraging others to join in this type of study.” Dozens of new authors have found their voice in the pages of Hakirah, but they have been joined by established authors, prominent talmidei hakhamim and noted academics in Jewish studies, as well as accomplished scientists and scholars of the law and the humanities. We stated in our mission statement that we wished to “create a forum for the discussion of issues of hashkafah and halakhah relevant to the community from a perspective of careful analysis of the primary Torah sources,” and indeed the most crucial and controversial issues facing Jewry have been discussed in these pages. The “Torah and Science” controversy of 2004, the proper procedures for gerut, the prospect of women rabbis, the Torah attitude towards homosexuality, Orthodoxy’s stance and responsibility toward the state of Israel, and Judaism’s stance in the divide between liberalism and conservatism, as well as many other issues, have all been debated here. And in this tradition, the Forum section of this edition deals with whether the issue of humane treatment for animals is a matter of moral concern for religious Jews or just an overhyped part of the political correctness agenda of the “progressive” left... A fitting close to the introduction to this edition of Hakirah is the acknowledgment of the loss this past Av of Flatbush resident Dr. Yaakov Elman z”l. Reb Yaakov was an internationally renowned academic scholar as well as an exceptional talmid hakham who made major contributions in several different areas of Jewish scholarship. The titles of his two Hakirah articles, “Rava as Mara de-Atra in Mahoza,” and “Pahad Yitzhak: A Joyful Song of Affirmation,” give one an idea about the range of his expertise. He was a ben Torah and ba‘al middot who was a friend to several members of the Hakirah editorial board, whom we learned with and from, and he was a friend to Hakirah itself with whom we would consult on areas beyond our expertise. In a letter in Hakirah 2, responding to our initial edition, he ended with: “I wish you all the luck in the world in cultivating intellectual curiosity in Flatbush and among frum people in general. Decades of experience have shown me how difficult a task that is. Good luck!” We would often laugh together about this, as apparently his “good luck” berakhah was fulfilled. Sometime later he told us that “Hakirah gave him hope,” and shortly after that he began contributing himself. Dr. Elman left many unfinished works, and it is our prayer that the topics over which he toiled will be continued to be explored in the pages of Hakirah.

Ḥakirah is honored to present lectures given approximately 70 years ago by Ha-Rav Yosef Dov Soloveitchik, zt”l on the opening verses of the Torah. In the five lectures presented here as the first of three installments, the Rav’s focus is on the question raised by the Amora Rav Yitzḥak as to why the Torah dwells on the story of creation and what philosophical truths we are to learn from it. Further delving into the Rav’s philosophical works is a review essay on Nietzsche, Soloveitchik and Contemporary Jewish Philosophy. The reviewer argues that “R. Soloveitchik took secular philosophy as a foil rather than as a foun-dation for his own hashkafa, which was deeply rooted in Jewish sources.”While the Rav’s work was often dedicated to harmonizing Torah hashkafa and halakha, in our Jewish Thought section we deal with two other twentieth-century Jewish thinkers who emphasized one above the other and who consequently are considered on the fringes of Orthodoxy. In an “Introduction to Rabbi Abraham Joshua Heschel’s Philosophy” we see that for Heschel the values and philosophy of Judaism overshadowed the importance of halakha. On the other hand, in “Sanctifying Our Choices: The Solution to the Paradox of Orthodoxy,” an essay on the thought of Prof. Yeshayahu Leibowitz, we see that his thinking was the reverse, that all emphasis should be placed on halakha.The thought of another famous thinker who dealt with the challenges of modernity is explored in “Rabbi Samson Raphael Hirsch on Jews in a Non-Jewish World,” which features the first English language translation of a book review by Rav Hirsch where he expounds about the appreciation Jews can get about Judaism itself from reading works that deal with Christian life. And in “The Life and Work of Dr. Menachem Mendel Yehudah Leib Sergei: A Torah U-Madda Titan in the Early Twentieth Century” we are introduced to and inspired by a unique but overlooked Jewish physician “who combines Torah, fear of G-d, and wisdom in an extraordinary way.”Several articles deal with censorship. In our Forum section, two scholars debate whether ArtScroll censored Rashi to disguise a non-traditional opinion of his, and present differing views on Rashi’s inter-pretation of the term tikun soferim. In “The Brothers Tugendhold &amp; Jewish Censorship in the Nineteenth Century: Addition and Subtrac-tion in the Warsaw 1853 Ḥumash,” the author examines the motives and guidelines behind Jewish self-censorship a century ago. In “The Ban on R. Yeḥiel Michal Pines in Jerusalem and his relationship with his brother-in-law, Rabbi David Friedman of Karlin,” we read of another type of “censorship” targeting what the Zealots of Jerusalem considered the intrusion of foreign influences into the Holy City of Jerusalem. In our Minhag section in an article entitled “Is it Permissible to turn one’s back to the Hekhal or Kotel During Qabbalat Shabbat?” the author objects to what he considers an errant new custom.A Hebrew article on Halakha looks at the RCA’s prenuptial agreement, calling for its wider acceptance, while an English-language article “A Prenuptial Agreement by and for the Ḥaredi Community” presents a new such agreement that has haskamot from the Ḥaredi world.Apropos of the season of Teshuva, a comprehensive article on “Rehashing The Free Will Question” examines all the explanations that have been put forth over the generations to deal with this challenging issue. In our Torah and Medicine Section “Epigenetics Revolution: The Power to Self-regulate and Control Human Behavior” issues of halakha and hashkafa are addressed, as the authors use the latest advances in science to propose “that there might be a molecular/cellular understanding, based on epigenetics, of how a lifestyle devoted to doing mitzvot can enhance this capacity to control behavior.”
