This book analyses the tax law of the European Union, which has developed in the space between the national legal orders of the Member States on the one hand and the international regime (particularly the influences of the OECD, including BEPS) on the other. Die Menschenrechte in den amerikanischen Staaten riickten in den siebziger Jahren verstarkt in das BewuBtsein der Offentlichkeit. Zum einen trat im Jahre 1978 die Amerikanische Menschenrechtskonvention (AMRK) in Kraft, auf deren Grundlage 1979 ein Interamerikanischer Gerichtshof ftir Men- schenrechte errichtet wurde. Zum anderen machte Prasident Carter die Men- schenrechte zum wesentlichen Bestandteil der amerikanischen AuBenpolitik, indem die Gewahrung finanzieller Mittel im wirtschaftlichen und strategi- schen Bereich gesetzlich an eine Verbesserung der Lage der Menschenrechte gekntipft wurde. Die Menschenrechtspolitik Carters wurde teilweise kriti- siert. Andererseits ist die Austibung politischen Drucks durch andere Staaten und durch die Offentlichkeit eines der wenigen verbleibenden Mittel zur Durchsetzung internationaler Menschenrechtsstandards, wenn die beschul- digten Staaten den Empfehlungen internationaler Sicherungsorgane nicht auf Grund eines allgemeinen Konsenses tiber den Schutz der Menschenrechte nachkommen. Die weitgehende Politisierung unterscheidet das interamerikanische vom europaischen System zum Schutz der Menschenrechte. Der institutionelle und der normative Rahmen der Sicherungsverfahren ist zwar in den amerika- nischen Staaten und in Europa sehr ahnlich. Aber die Entscheidungen und die Praxis der Schutzorgane sowie die Setzung von Schwerpunkten bei ihrer Arbeit weisen erhebliche Unterschiede auf. DaB das Verfahren der Interame- rikanischen Menschenrechtskommission (IAKMR) in minderem MaBe juri- stisch formalisiert ist, muB nicht unter jedem Gesichtspunkt nachteilig sein. Auf weIche Art und Weise sich die Menschenrechte am besten durchsetzen lassen, kann nicht losgelost von den soziopolitischen Randbedingungen beur- teilt werden.
