With the rapid advancements in computer technology over the past few years, there has been increasing concern on the need to develop the law in order to take full advantage of technological improvements , and also to ensure that states can respond to computer crime and related criminal law issues. The sharp increase in the contingent liabilities of many countries in recent years and the change in the nature of the financial burden of the fiscal authorities have been primarily attributed to the transformation of the role of the state from a supplier of certain services to a facilitator, where the state extends guarantee to the private sector for providing services.Contingent liabilities featured prominently in the recent Asian crisis and stressed the need for countries to develop a framework to monitor these liabilities. However, despite the need to quantify contingent liabilities as a way of avoiding financial crisis, very few countries have developed a framework to monitor these liabilities. This report focuses on some of the issues germane to the identification, monitoring and valuation of external-sector related contingent liabilities. By focusing mostly on external-sector related contingent liabilities that involve possible financial transactions with non-residents in India, it develops a useful framework for use by other countries.This is a pioneering document in an area generating a lot of interest.

Victims of crime are sometimes overlooked when consideration is given to reforming the criminal justice system of Commonwealth countries. This leads to the incorrect perception that ‘criminals have more rights than victims’. It detrimentally affects the public perception and support for fundamental human rights provisions in the law, especially those dealing with the rights to a free trial. It also erodes confidence in the judiciary and justice systems.The United Nations “Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power” defines victims as persons who have suffered harm including physical or mental injury, emotional suffering, economic loss or substantial impairment of their fundamental rights through acts or omissions in violation of criminal laws operative in domestic legislation.This publication sets out best practices and guidelines of dealing with those victims at various stages in the criminal justice systems in the Commonwealth, including the role of police, prosecutors and courts. It also looks at issues of compensation and restitution for victims of crime. The Expert group consisted of experts drawn from across the Commonwealth.

Starting from the premise that democracy is more than simply a matter of universal suffrage and the holding of regular multiparty elections, and that development is about much more than growth of GDP, this Report focuses on how to make democracy work for pro-poor development and on development policies that in themselves uphold and promote democratic values. It argues that development and democracy are not only goals in their own right but must also be mutually reinforcing.Pro-poor development recognises that people need the ‘capabilities' to do and be the things that they have reason to value, such as being adequately nourished, having equitable access to justice and participating in decisions that affect their lives. It also recognises that development policies aimed at the general populace may have a more limited positive impact on particularly disadvantaged groups. Such groups need to be identified (for example, in terms of gender, ethnicity, religion, age or occupation) and policies need to be specifically designed for improving the lives of the poor.The Report argues that governments, the private sector, civil society and the international community each have a vital role to play in delivering development and democracy, and calls for responsibility, partnership and concrete actions from all these actors. Without responsibility on all these levels, development and democracy will remain rhetoric rather than become reality.Prepared by the Commonwealth Expert Group on Development and Democracy at the request of Commonwealth Heads of Government, the Report contains a number of recommendations for action at the national and international levels.
